Decision:

The Licensing sub-committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

? The prevention of crime and disorder;

? Public safety;

? Prevention of public nuisance;

? The protection of children from harm;

 

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing Policy and the conditions set out in paragraph 8.1

of the report, with the following amendment :-

 

The opening hours and the hours for licensable activity are:

 

Opening Hours:

 

Monday to Thursday (Online deliveries only) - Not opened for public

 

Friday to Sat 12:00 to 23:00 (Not opened for public from 22:00 to 23:00)

 

 

Sunday  12:00 to 23:00 (Not opened for public from 21:00 to 23:00)

 

Supply of Alcohol (Off Sales) 

 

Monday to Thursday (Online deliveries only) - Not opened for public

 

Friday to Saturday  12:00 - 23:00 (from 21:30 to 23:00 online deliveries 

only)

 

Sunday  12:00- 23:00 ( from 20:30 to 23:00 online deliveries only) 

 

Supply of Alcohol (On Sales ) 

 

Friday - Saturday   12:00 - 21:30

Sunday   12:00 - 20:30

 

And the following conditions:

 

Amend condition 15 to read as follows:

 

“Any off sales of alcohol will be in sealed containers and alcohol shall not be 

consumed on the premises from Monday to Thursday”

 

 

The Premises Licence holder to provide the Licensing Authority with an updated plan of the premises excluding the external area.

 

There shall be a maximum of 3 smokers outside the premises at any one time, and smokers are not permitted to take drinks outside of the premises at any time. 

 

No drinks are permitted in the external /outside area of the premises at any time. 

 

The capacity of the premises to be 20 persons at any one time.

 

To ensure that persons purchasing alcohol via the on-line platform are over the age of 18, the company shall ensure that customers are aware that proof of ID will be a condition of sale and must be provided prior to receipt of any alcohol, delivery drivers will be instructed to ensure that the end consumer is the same individual that placed the order or no delivery shall take place.

 

Delivery drivers shall conduct the delivery in a manner that will not cause a noise disturbance to the occupiers of any residential properties surrounding the delivery address. This includes the avoidance of slamming doors, playing loud music, shouting, over-revving engines and sounding horns to signal their arrival. The driver shall turn the engine off immediately upon arrival at the delivery address and will park considerately without causing any obstruction to the highway.

 

All deliveries of alcohol shall only be delivered to a premises address with a valid postcode and will only be delivered directly to that property.

 

The Premises Licence Holder shall organise and publicise a meeting for local residents to meet and discuss the operation of the premises at least every 3 months.

Exempt information

 

On occasions, some applications will be heard in private and not open to the press and public if discussions are likely to lead to the disclosure of exempt or

confidential information.

 

The consideration of exempt information is in accordance with Access to Information Rules set out at Part 4,2 paragraph 17.3 of the Council’s constitution.

 

The following recommendation allows for the consideration of exempt information at agenda item 7.

 

RECOMMENDATION:

 

That the Press and Public be excluded from the meeting during the

consideration of agenda item 6 due to the disclosure of exempt information as defined under paragraph 7, Part 1, Schedule 12A of the Local Government Act 1972.

Decision:

The applicant had agreed interim steps with the Police. Therefore this item was

now  withdrawn from the meeting agenda.
