Application for a Premises Licence - Ground Floor and Basement, 66-68 Kingsland Road, E2 8DP

The decision

 

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

  • The prevention of crime and disorder;
  • Public safety;
  • Prevention of public nuisance;
  • The protection of children from harm;

 

The application for a premises licence has been approved in accordance with the Council’s licensing statement and paragraph 8.1 of the report, with the following amendments and additional conditions :-

 

·  The opening hours and the hours for licensable activity, as agreed with the Metropolitan Police are:

 

Opening Hours:

 

Monday to Thursday  10:00 - 00:30 hours

Friday and Saturday   10:00 - 02:00 hours

Sunday    10:00 – 00:30 hours

 

Supply of Alcohol (on the premises):

 

Monday to Thursday  10:00 - 00:00 hours

Friday and Saturday  10:00 - 01:30 hours

Sunday    10:00 – 00:00 hours

 

Late Night Refreshment:

 

Monday to Thursday  23:00 - 00:00 hours

Friday and Saturday  23:00 - 01:30 hours

Sunday    23:00 – 00:00 hours

 

Recorded Music:

 

Monday to Thursday  10:00 - 00:00 hours

Friday and Saturday  10:00 - 01:30 hours

Sunday    10:00 – 00:00 hours

 

·  Off sales of alcohol have been removed from the application.

 

·  Condition 11 will be amended to read:

There shall be SIA registered door supervisor employed at the premises on Friday and Saturday from 22:00 hours at a ratio of 1:100.  Extra SIA will be considered continually as part of an ongoing operational risk assessment. All door supervisors shall enter their full details in the premises daily register at the commencement of their work. They shall record their full name, home address and contact telephone number, their SIA registration number, and the time they commence and conclude working. If the door supervisor was provided by an agency the name, registered business address, and contact telephone number will also be recorded. This register will be made available to the police or authorised officer immediately upon request.

 

 

Along with the following additional conditions:  

 

·  No person shall be employed to solicit for custom or be permitted to solicit for custom for business for the premises in any public place.

·  There shall be no glass, drinks or open containers taken outside of the premises at any time. This will be monitored by staff.

·  After 2100hrs there shall be a maximum of 6 smokers outside of the premises at any one time.  This shall be monitored by staff/door supervisors.

·  The capacity of the ground floor be limited, to no more than 100 patrons, at any one time.

 

·  The capacity of the basement be limited, to no more than 50 patrons, at any one time.

 

 

 

Reasons for the decision

 

The application has been approved, with the above amendments as the Licensing Sub-Committee was satisfied that the licensing objectives would not be undermined. 

 

The Licensing Sub-Committee took into consideration that the Metropolitan Police Service had withdrawn their objections in advance of the hearing as the applicant had agreed their proposed amendments and additional conditions. The Licensing Sub-Committee also noted that one of the local residents had withdrawn their representation following the applicant’s agreement with the police. 

 

The Licensing Sub-Committee also took into consideration the experience and good track record of the management, and the applicant’s familiarity with the nature of the area. The Licensing Sub-Committee also noted that the applicant’s willingness to liaise with the police and local residents to meet any concerns that they may have had.
