Decision:

The decision of 28th September 2023

 

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing today and having regard to the promotion of the licensing objectives:

 

·  The prevention of crime and disorder

·  Public safety

·  Prevention of public nuisance

·  The protection of children from harm

 

The amended application to vary a premises licence has been approved to change the layout of the premises in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

 

Reasons for the decision

 

The amended application to vary this premises licence has been approved to change the layout of the premises, as members of the Licensing Sub-committee were satisfied that the licensing objectives would not be undermined.

 

The Sub-committee took into consideration that the Environmental Health Pollution Authority and the Licensing Authority had withdrawn their representations, and agreed conditions with the licence holder in advance of the hearing.

 

The Sub-committee noted there was only one representation from a local resident. The local resident who attended confirmed that they had no objection to the change of the layout and the amended application that was now proposed by the Applicant The local resident confirmed that their only objection was the additional external area that was previously proposed.  The Sub-committee noted there is no other change to the premises.

 

The Sub-committee heard from the Applicant’s legal representative that the pub has been there since 1812, the toilets on the premises have been moved from the ground floor to the first floor. The customers will not have access to the external area. The Sub-committee took into account that the Applicant will not undermine the licensing objectives and is pleased to accept the amended application to amend the layout only.

 

The Sub-committee took into consideration that the Applicant amended their application once they received representations from local residents wanting to preserve the area. The Sub-committee noted that the Applicant does not own the land. Therefore, the Applicant withdrew their application to add the external area. The Sub-committee took into account that the Applicant is an experienced operator, and the premises is operated by Green King who provide a great deal of training and support to their tenants to help them operate the premises responsibly.

 

The Sub-committee took into account that the Applicant would be happy to carry out any additional training offered by the Hackney Nights portal. The Sub-committee noted that the premises are inclusive, and the internal changes to the layout are part of an investment program which will make it more accessible for customers.

 

Having taken all of the above factors into consideration the Sub-committee was satisfied that by granting this variation to the licence to change the layout to the premises, the licensing objectives would continue to be promoted.
