Decision:

The Licensing Sub-Committee heard the representations from the parties, however, before the hearing concluded the Licence holder decided to WITHDRAW their application to vary a premises licence.

The decision

 

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

The prevention of crime and disorder;

Public safety;

Prevention of public nuisance; and

The protection of children from harm,

 

the application for a premises licence has been approved in accordance with the Council’s Statement of Licensing Policy and the proposed conditions set out in paragraph 8.1 of the report, with the following amendments:

 

 

The hours for licensable activities, shall be, as agreed:

 

 

Late Night Refreshment:

 

Friday - Saturday  23:00 - 01:00

 

Opening hours of the premises

 

Monday - Thursday  12:00 - 23:00

Friday - Saturday  12:00 - 01:00

Sunday    10:00 - 23:00

 

 

And the following condition:

 

Deliveries and take away only are permitted under this licence.

 

The minimum number of staff must be 4

 

The Licence holder to submit a Dispersal Policy to the Licensing Authority and the Police for approval and to be available on request by  an authorised Council officer

 

The Licence holder to submit a Delivery Management Plan to the Licensing Authority and the Police for approval.

 

 

 

 

 

 

Reasons for the decision 

 

The amended application for a premises licence has been approved because the Licensing Sub-committee was satisfied that the licensing objectives would not be undermined.

 

The Sub-committee took into consideration that the Applicant agreed conditions with the Environmental Enforcement Team, the Environmental Protection Team and the Metropolitan Police Service in advance of the hearing. These Responsible Authorities subsequently withdrew their objections to this application.

 

The Sub-committee took into consideration the objection to the application made by the Licensing Authority on the grounds of the prevention of public nuisance, and the objection raised by a local resident (Other Person) objecting to this application on the grounds of the four licensing objectives.

 

After hearing from the Applicant and considering the representations of the Licensing Authority and the local resident, the Sub-committee believed that the above measures put in place including reduced hours and no customers on the premises after 23:00 would mitigate any potential negative impact in the area.

 

The Sub-committee felt that the issues in the past regarding the opening hours were isolated incidents, and there were no anti-social behaviour issues associated with the premises.

 

Having taken all of the above factors into consideration the Licensing Sub-committee was satisfied that this amended application could be approved without the licensing objectives being undermined.

 

 

Public Informative

 

The Applicant is strongly encouraged to use sustainable cutlery, plates, cups, food containers, and recyclable materials to avoid using single-use plastic disposable items to prevent litter, and to protect the environment.
