APPLICATION FOR A PREMISES LICENCE   GYOZA TOWN, GROUND FLOOR,

354 MARE STREET, HACKNEY, LONDON, E8 1HR – APPROVAL

 

The decision of 14th April 2020

 

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

?  The prevention of crime and disorder;

?  Public safety;

?  Prevention of public nuisance;

?  The protection of children from harm;

The application has been approved in accordance with the Council’s statement of licensing policy and the proposed conditions set out in paragraph 8.1 of the report with the following agreed amendments:

 

·  Condition 8 shall be amended and read as follows:

“Substantial food and substantial beverages other than alcohol (including drinking water) shall be available in all parts of the premises where alcohol is sold or supplied until 30 minutes prior to closing daily”

 

·  Condition 35 shall be amended and read as follows:

“The premises will trade solely as a ‘gyoza bar’ where gyoza is available to customers until 30 minutes prior to closing daily. Any changes to the operation must be notified to the police in advance of an application being submitted to vary this condition”

 

·  Condition 36 shall be amended and read as follows:

“Customers will only be permitted to stand in the premises if at a standing table or in the bar area where no more than 20 persons will be permitted to stand”

 

In addition to the conditions;

 

i) As agreed:

 

·  The external area shall be closed to the public at 22:00 hours daily and shall not re-open until the start of trade the following day, with the exception of smokers immediately outside the front of the premises who will not be permitted to take drinks outside after 22:00 hours.

 

·  The maximum number of persons (excluding staff) allowed in the external area of the premises shall not exceed 30 patrons.

 

·  The external area will display notices advising customers that the area is for seated patrons only and customers that are not seated will be asked to leave this external area. Service to this area will include on a Thursday, Friday and Saturday night between 17:00 hours until close, which will be by waiter/ waitress only between the months of April and September.

 

·  Patrons will not be permitted to take drinks into any external area not enclosed by barriers. Signs will be displayed to this effect.

 

·  The external area is the area immediately adjacent to the premises, on the right hand side (when looking at the premises from the front). Alcohol will only be consumed in this area by the outside patrons.

 

·  The external area will be supervised and managed by staff at all times.

APPLICATION FOR A PREMISES LICENCE – FANNY’S KEBABS, BASEMENT AND GROUND FLOOR, 92 STOKE NEWINGTON HIGH STREET, HACKNEY, LONDON, N16 7NY – APPROVAL

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

?  The prevention of crime and disorder;

?  Public safety;

?  Prevention of public nuisance;

?  The protection of children from harm;

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing Policy and the proposed conditions set out in paragraph 8.1 of the report, with the following amendments:

 

·  All licensable activity Sunday to Wednesday to conclude at 23:45 hours, with the exception of Sale and Supply of Alcohol, which will cease at 23:30 hours, with the premises closing at Midnight

·  All licensable activities on a Thursday (except plays and films, which conclude at 23.45 hours) to cease at 00.30 hours, with the premises closing at 01.00 hours

·  All licensable activities on a Friday and Saturday (except plays and films, which conclude at 23.45 hours) to cease at 01.00 hours, with the premises closing at 01.30 hours

·  Conditions 10 and 12 within paragraph 8.1 to be deleted (due to duplication)

·  The conditions within the existing premises licence (premises licence number 090237) be transferred to this new premises licence, apart from conditions, 10, 11 and 18 – to avoid any duplication.

 

Reasons for the decision

 

The application has been approved, with the relevant amendments and additional conditions, as the Licensing sub-committee was satisfied that the licensing objectives would not be undermined.

 

The sub-committee took into consideration the representations of the Metropolitan Police and noted that no other Responsible Authorities or local residents raised objections to this application.

 

The sub-committee also took into consideration that the applicant currently has a premises licence for the premises since 2017 and previously held Temporary Event Notices, which took place at the premises without incident.

 

After hearing from the applicant and considering the representations of the Metropolitan Police, the sub-committee believed that the measures put in place would mitigate any potential negative impact in the area.

 

Having taken all of the above factors into consideration the Licensing sub-committee were satisfied that granting the application would continue to promote the licensing objectives.

 

 

Public Informative

 

It should be noted for the public record that the Premises Licence Holder agreed with the Police to surrender the existing licence when this new licence was issued. The Sub-Committee, expect the surrender of the existing licence to take place within 14 days of the new licence being provided.
