Application to vary the premises: The Barge House, 46a DeBeauvoir Crescent, N1 5RY pdf icon PDF 3 MB

Minutes:

6.1   Mike Smith, Principal Licencing Officer, introduced the application to vary the premises at The Barge House, 46a De Beauvoir Crescent, N1 5RY, under the Licencing Act 2003, and following agreement with the Police, the amended conditions were as follows:

 

·  50.’ The Number of patrons allowed outside the premises including to smoke at any one time to be limited to 10’ – to be deleted and replaced with ‘The number of persons seated on the outside terrace be limited to 28 at any other time’.

·  51. All Patrons outside to be seated, including smokers

·  52. All alcohol served outside to be by waiter/waitress and to be ancillary to a table meal.

·  54. There should be no use of any outside area by customers after 22.00.

 

6.2  The Sub-committee noted that several local residents had raised objections about the application. 

 

6.3  Liam O’Hare, the agent on acting behalf of the applicant, began by briefly explaining the background to the application.  The Barge House had undergone a dramatic change in direction from the previous business and license holder in response to recent changes in the Hackney area. Results of a recent survey of customers and staff had favoured longer hours and an extension of the capacity outside. The Barge House had also conducted two public consultations on the proposed changes.

 

6.4  Liam O’Hare queried recent complaints against the Barge House. The Council’s noise team had investigated two reported complaints and had concluded that the Barge House was not the source. He added that the proposed terrace would operate a reservations system supported by a dedicated waiting team. Large group bookings would be discouraged after 18:00 hours.

 

6.5  Councillor Emma Plouviez raised a query over whether the proposed fencing for the terrace was permanent.

 

6.6  Debbie Maylynn replied that moveable planters would act as fencing to direct and soften noise levels. She added that the towpath would not be blocked.

 

6.7  David Tuitt, the Licensing Authority, explained that there were no concerns over the proposed early opening hours. Removal of the three conditions, regarding use of the outdoor area, however, could impact on the promotion of the licensing objectives, particularly regarding the prevention of public nuisance. A similar application had been rejected by the Licensing Sub-Committee on 17 September 2015 partly because of the potential impact on nearby residents.

 

6.8  Other persons made representations at the meeting. A number of concerns were raised about the impact of the application on noise levels and public safety. Any increase in the number of patrons, because of the acoustics in the area, would lead to an amplification of sound, which would reverberate across the canal. Residents were particularly concerned that excessive noise would disrupt their children’s sleep patterns. Residents had recently complained about the existing noise levels, but had found the level of response from the Barge House unsatisfactory. There was also a worry that additional patrons may spill out into the towpath knocking into cyclists and pedestrians especially during the summer.

Application for a premises licence: By the Bridge, 283a Kingsland Road, E2 8AS pdf icon PDF 1 MB

Minutes:

7.1   Mike Smith, Principal Licensing Officer, introduced the application for a premises licence for By the Bridge, 283a Kingsland Road, E2 8AS.

 

7.2  The Sub Committee noted that just prior to the meeting the applicant, in agreement with the responsible authority (police), would amend the existing conditions and agree to some additional conditions too.

 

7.3  By the Bridge was currently a coffee shop seating 12 persons. It was now seeking a late night refreshment license to serve wines and beers alongside food platters. The number of smokers would be limited to three outside. This was not expected to impact on the small path near the premises and canalside.

 

7.4  The responsible authority, Police Constable Amanda Eva, outlined the police’s concerns about the impact of the application, as the premises was in an area well known for weekend incidents of drunkenness and disorder.

 

7.5  Other persons in their representations raised similar concerns to the police over the impact of a change in licence on noise levels and public safety in the area. 

 

7.6  The applicant replied that the café did not want to be a wine bar and it was not expecting a fast turnover of customers. In response to resident’s concerns over noise coming from the rear of the premises, the applicant agreed to close the window after 22:00 hours.

   

 

The decision

The Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

  The prevention of crime and disorder;

  Public safety;

  Prevention of public nuisance;

  The protection of children from harm;

 

The Sub-Committee approved the application in accordance with the Council’s licensing statement and the proposed conditions set out in paragraph 8.1 of the report, subject to the following agreed amendments:

 

·  The premises is to close at midnight Monday to Sunday, with the licensable activities ceasing at 23.30 hours

·  Conditions 8 and 9 be deleted and replaced with the conditions agreed with the Police

 

 

 

And additional conditions:

 

·  The following conditions agreed with the police;

 

1.  The premises shall maintain a comprehensive CCTV system as per the minimum requirements of a Metropolitan Police Crime Prevention Officer. All public areas, entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Recordings shall be made available immediately upon the request of Police or authorised officer.
