RESOLVED: The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

 

·  The prevention of crime and disorder

·  Public safety

·  Prevention of public nuisance

·  The protection of children from harm

 

the application for a premises licence has been approved as applied for in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report, with the following condition to

be added to the licence:

 

·  The Premises Licence holder shall ensure that there will be no new customers admitted to the licensed premises from one hour prior to the closure of the premises.

 

Reasons for the decision

The application for a premises licence has been approved as applied for as members of the Licensing Sub-committee were satisfied that the licensing objectives would not be undermined.

 

The Sub-committee took into consideration that the Responsible Authorities (the Licensing Authority, the Metropolitan Police Service (“the Police”) and the

Environmental Enforcement Team) made representations on the grounds of prevention of public nuisance and crime and disorder. The Sub-committee noted that the Applicant agreed to the Environmental Enforcement conditions set out in the Licensing report at paragraph 8.1. The Sub-committee noted that no other Responsible Authorities made representations about the application.

 

The Sub-committee took into account that there were 4 representations made

by Other Persons (local residents) objecting to the application on the grounds of the four licensing objectives. The Other Persons did not attend the hearing, however, their written representations were taken into consideration in relation to the impact on local residents and the residential area.

 

The Sub-committee heard Representations from the Applicant’s representative that the premises is not in a Special Policy Area, and the smoking area is on the left-hand side on the main street. The Sub-committee heard that customers are not allowed to smoke on Philip Street, and the Applicant has good control over the smoking area. The Sub-committee took into consideration that there would be a maximum of 10 smokers in the smoking area at any one time. The Sub-committee noted that the Applicant has held successful temporary events at the premises. The Applicant contended that the premises would not negatively impact the area.

 

The Sub-committee took into consideration that the Responsible Authorities and local residents had concerns about the premises and the impact it will have on local residents late at night who live near to the premises.

The Sub-committee felt that the Applicant has proved that they have been operating within the licensing objectives and the Applicant has agreed to the above last entry condition. The Sub-committee took into consideration the issues relating to the smoking area and that a written dispersal policy was required as a condition on the premises licence.

 

Having taken all of the above factors into consideration the Sub-committee was satisfied that by granting this premises licence, the licensing objectives would not be undermined.
