Decision:

The decision of 9th January 2020

 

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

  • The prevention of crime and disorder;
  • Public safety;
  • Prevention of public nuisance;
  • The protection of children from harm;

 

The application for a premises licence has been approved in accordance with the Council’s licensing statement set out in paragraph 8.1 of the report, with the following additional condition:

 

·  The total capacity of the premises (including staff and patrons) shall be limited, to no more than 100 patrons, at any one time. 

 

And the following additional Environmental Protection conditions agreed by the Applicant:

 

·  The maximum number of persons allowed to use the designated smoking areas at each end of the outside drinking area (on the right and left side) of the premises at any one time is restricted to 4 people.

 

·  Notices shall be prominently displayed at any area used for smoking, requesting patrons to respect the needs of local residents and use the area quietly.

 

·  Staff shall monitor customers smoking outside the premises on a regular basis and ensure patrons do not cause a public nuisance.

 

 

Reasons for the decision

 

The application for the premises licence has been approved, with the above additional conditions, as the Licensing sub-committee was satisfied that the licensing objectives would not be undermined.

 

The sub-committee took into consideration that the Metropolitan Police had withdrawn their representation in advance of the hearing, and following the Applicant agreeing to the proposed conditions.

 

The sub-committee also took into consideration that the Environmental Protection Team and Environmental Enforcement had withdrawn their representation in advance of the hearing, and following the Applicant agreeing to additional conditions.

 

After hearing from the Applicant, and considering the representations of the Other Persons the sub-committee were satisfied that the conditions that the Applicant agreed to would promote the licensing objectives.

 

The sub-committee took into consideration that the relatively early hours applied for were within Core hours under the Council’s Policy LP3, and the Applicant’s understanding of the risk of nuisance caused by the Cumulative Impact of a licensed premises in the Shoreditch area.

 

Having taken all of the above factors into consideration the Licensing sub-committee were satisfied, when granting the premises licence, that the licensing objectives would be promoted, particularly in relation to the prevention of crime and disorder and prevention of public nuisance.
