Decision:

4.1  The Principal Licensing Officer introduced the application for

an application for a premises licence to allow authorisation for the sale of alcohol on Monday to Sunday.

 

4.2  Andy Newman (Consultant) spoke in favour of the application,

highlighting the following;

 

·  The premises was to be small with no more than 30 patrons;

·  The premises was located in the shoreditch Special Policy Area;

·  No other Responsible Authorities had made representations against the application;

·  The Applicant had much experience of running similar premises and was a responsible operator and would use local suppliers;

·  The premises would cause little cumulative impact on the area;

·  Attractive offering for local people;

·  A licence was required because this would be expected by the clientele and would make the venture viable;

 

4.3  The Principal Licensing Officer told the Sub-Committee that his

  concerns had been alayed as a result of agreement in the

  following areas:

 

·  No deliveries to the premises from 7am on any day;

·  The premises would not operate takeaway;

·  Agreement to the Challenge 25 Scheme;

·  Hours - 11am to 11pm - Monday to Saturday;

·  Hours - 10am to 8pm - Sundays

·  Alcohol was to be ancillary to food;

·  Smokers limited to 10 persons after 10pm;

·  No cumulative impact was expected.

 

4.4  The Chair asked if the applicant would accept a closure time of

  10:30pm on Sundays. Andy Newman agreed to a closure time of

  10:30 on Sundays.

 

4.5  Councillor Sheila Suso-Runge asked for clarification in regard to any cumulative impact arising and how it could be addressed.

 

4.5  The Principal Licensing Officer confirmed that this was to be a

table service restaurant, alcohol would be ancillary to food and

the hours were not problematic. Despite the premises being In the

SPA the experience was that such premises tended not to be as

problematic as vertical drinking premises. It was considered that

the cumulative impact would be minimal. 

 

4.6  In closing, Andy Newman submitted that the applicants had a

Good background in premises management. No responsible

authorities had objected to the application.  Cumulative impact

would be minimal.

 

4.7   The Principal Licensing Officer considered that given the

agreement in relation to the premises the cumulative impact

would not be significant.

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

·  The prevention of crime and disorder

·  Public safety

·  Prevention of public nuisance

·  The protection of children from harm

 

the application for a premises licence has been approved to in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report, with the following amendments:
