Decision:

 Blondies, 449/449a Amhurst Rd – Application for a Premises Licence

 

The decision of refusal - 13th February 2020

 

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

 

  • The prevention of crime and disorder;
  • Public safety;
  • Prevention of public nuisance;
  • The protection of children from harm;

 

The application for a premises licence be refused having regard to the Council’s Statement of Licensing Policy, in particular LP1 & LP2.

 

Reasons for the decision

 

The Licensing Sub-Committee after hearing the representations and concerns raised by the Licensing Service, Police and residents, along with the presentation and responses provided by the applicant were of the view that the licensing objectives would be undermined if the application was granted.

 

It was noted that the applicant accepted that they were ill advised with regards to advertising and promoting this application, by encouraging free drinks at their existing premises in exchange for support of their application. It was also noted that the applicant had made considerable amendments to their application both before and at the hearing in terms of reduction of hours, removal of activities along with additional conditions.

 

However, the sub-committee were of the view that the premises was simply not a suitable venue, both structurally and given its location/proximity to residents, for the type of operation that was still being outlined at the hearing. The responsible authorities and residents highlighted that given where the premises is situated and its design, it would almost inevitably change the character along with exacerbating the existing problems in the area and would as such lead to more nuisance and disorder being created.

 

In making this decision the Sub-Committee also took a dim view of the actions by the applicant during the application process and did not feel they had the sufficient level of confidence in the applicant’s ability to comply with the requirements and demands that would be placed on the applicant if a premises licence was granted at this location.

 

Therefore, having regard to the concerns raised during the application process and at the hearing, the sub-committee believed that the licensing objectives would not be promoted by granting the application and as such believed it was appropriate to refuse the application in its entirety.
